Terms and Conditions
Please read this Customer Agreement carefully before signing up to use any of EMT Medical’s Services or Products.
By using EMT Medical’s services, you agree to these Terms and Conditions. EMT Medical may revise these terms at any time and will notify you of any changes by emailing you the change and posting the modified terms on the website.
EMT ALERT’S MEDICAL ID SYSTEM
Signing Up
Signing up is accomplished by completing the personal and medical information form online or by calling EMT Medical at 1-800-981-7636 to request a package containing the medical information forms that you may then complete and mail back to EMT Medical and EMT Medical will input your information into your online account. It is your responsibility to keep your account information current in order to maintain up to date information regarding your medical records. You may update your information at any time by going online and using your online ID and Password to edit your account. It is your responsibility to keep your Online ID and Password Confidential. If you forget your Online ID or Password, you may contact EMT Medical by email or phone and answer a privacy protected question of your choosing in order for us to ensure that you are the user requesting your Online ID or Password. EMT Medical only updates your information upon you providing it with updated information. EMT does not contact your medical providers to get updated information.
Membership Services and Fees
EMT Medical charges the following fees for its services:
1. Individual Plan: For a Two Hundred Eighty-Seven and Twenty-Five Cent ($287.25) one time fee (paid in advance of service) you will receive our Standard Plan benefits with no additional fees ever. There are no additional monthly or annual membership fees for this plan. In addition to our Standard Plan services, you will have the ability to store medical data such as MRI information, X-Rays, and other medical images** in your Personal Health Record. This plan applies to one (1) person.
2. Family Plan: For a Three Hundred Ninety-Eight Dollar and Twenty-Five Cents ($398.25), (paid in advance of services) you will receive the benefits of our Platinum Plan with no additional monthly or annual fees to pay ever. This plan includes Personal Health Records for up to six (6) members as well as six (6) Condition Access Cards. This plan is restricted to one (1) household and immediate family members***.
*read only access is a condition that allows information to read but prevents data from being changed via the emergency login.
**image data must be available via digital format or copies sent to EMT Medical for scanning.
***immediate family is defined as Member, Member’s Spouse/Domestic Partner, Children, Step-Children, Dependant child living in household.
UPDATE YOUR FILE
You are responsible for updating your file with any new information. You will be able to continuously update your file. You may instruct your medical professionals to send us a copy of your medical records and we will upload copies of your medical records without reviewing them to your records account which will be available to your doctors in case of an emergency.
You are responsible for reviewing all of the information and records that are maintained in your account. EMT does not review the information to make sure it is correct and is not liable for any errors in any information that you provided or that your medical professionals provided to EMT for uploading to your account.
By registering with EMT Medical, you authorize EMT Medical to charge your credit card in the amount of the Service Fee. EMT Medical retains the right, in its sole discretion, to increase, at any time, the Service Fee. You must pay the Service Fee on an annual basis, or as specified in the Services you select. The Service Fee will be charged to your credit card on the anniversary of your account activation or monthly if you choose the monthly service fee (the Billing Date), unless the account is terminated in accordance with the EMT Medical termination policies. You may update your credit card information at any time through the Billing Information profile.
Should your credit card be inactive or otherwise unable to process the Service Fee due at the Billing Date, EMT Medical will notify you by e-mail. You will then have 30 days to update your credit card information in the Billing Information profile. If at the end of 30 days your credit card is still inactive or unable to process the Service Fee due, EMT Medical reserves the right to remove your Primary Medical File and all other information from our database and server and terminate your access to and use of the Web site and all other services, without any further notice or any liability to you or any third party.
SERVICE TERM
The term for all EMT Medical Services you select for your Membership shall be specified and accepted by you at the initial registration (the "Service Term").
TERMINATION AND REFUND POLICY
You agree that EMT Medical may terminate your membership if you fail to pay the annual fee within 30 days of the expiration of your membership. You agree that EMT MEDICAL may restrict or terminate your use of the Web site or any other service of EMT Medical for any reason, with or without notice to you. You agree that EMT Medical may modify or discontinue EMT Medical, with or without notice to you. EMT Medical shall not be liable to you or any third party for any claim or cause of action arising out of such termination, restriction, modification or discontinuance.
You may CANCEL this transaction, without any penalty or obligation, by mailing a written request of cancellation, post marked and sent return receipt requested within THREE BUSINESS DAYS of the date of the transaction. After that you may still receive a full refund for any costs not incurred by EMT Medical for your service. Simply mail a written request, posted marked and sent return receipt requested within 30 days of the date of transaction. You may cancel your membership by submitting written notice to EMT Medical either by email to Membership@EMTmedical.net or mail to: EMT Medical, Inc.4960 S. Gilbert Rd. Suite 1-473 Chandler, AZ 85249.
After 30 days you shall not be entitled to a refund on any annual plan. There shall be no refund on any month to month plan.****
You agree that should you terminate your membership, online access to your EMT Medical account and records ceases as of the date of termination. After 30 days from the date of termination EMT Medical shall delete your EMT Medical account and all records from the server. You agree that EMT Medical is under no obligation to keep your account information and records subsequent to termination. Furthermore, you release EMT Medical from any and all responsibility and/or liability due to the accessibility and use, or lack thereof, of your account and records subsequent to termination.
****Unless superseded by local or state laws.
Disclaimer of Warranties
The information on this site is intended for general information purposes only and is not intended to replace the services of a trained healthcare professional. EMT Medical cannot render medical or any other advice. All information, including your Medical Profile and your Medical Records, are provided to EMT Medical by you and/or your healthcare provider at your request. EMT Medical does not inspect these records for completeness or accuracy. EMT Medical disclaims all representations and warranties, including, for example warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, no information, whether oral or written, obtained from you by EMT Medical or its agents or employees shall create any warranty not expressly made in these Terms & Conditions. If any applicable authority holds any portion of this section to be unenforceable, then warranties will be disclaimed to the fullest possible extent permitted by applicable law.
Email Communications
If you sign up online you must provide EMT Medical with your email address so that EMT may contact you by email if necessary. You may fax or mail in any updates to your medical information if you are unable to update your information online.

EMT Medical, Inc. shall not be held responsible or liable for any actions taken, either wholly or in part, based on the information provided on EMTmedical.net, or for any loss, damage, expense or injury resulting from any transactions conducted with EMTmedical.net. Liability Limitations
IN NO EVENT SHALL EMT MEDICAL, INC.’S TOTAL LIABILITY TO YOU FROM ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF EMT ALERT’S SERVICES, WHETHER IN CONTRACT, TORT, (INCLUDING, BUT NOT LIMITED TO NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EXCEED THE FEES PAID BY YOU TO EMT MEDICAL.
Dispute Resolution
We will try to resolve any problems or issues that you may have with our services or organization. If, we are unable to reach a mutually satisfactory resolution, each of us agrees that any dispute or controversy between us, or arising in any way out of the use or operation of our web site or other services, or any information, services, products, and materials contained in this site or available through our other services, shall be submitted to confidential arbitration in Phoenix, Arizona, except that, to the extent you have in any manner violated or threatened to violate EMT Medical, Inc.’s intellectual property rights, EMT Medical, Inc. may seek injunctive or other appropriate relief in any state of federal court in the state of Arizona, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise.
